You should use common sense when using an AI service – do not take any harmful action to yourself or others no matter what your impression is of the information which you receive – we offer an intelligent service which may guide your understanding, however it is still vulnerable to interpretation and like any form of communication may not always offer information ideal for the actual reality of your circumstance. Please use with discretion and always make your own decisions or refer to professional human services for critical decision making and diagnosis of psychological matters.

These Terms & Conditions ("Terms") govern your access to and use of Go Girlfriend (the "Service"), including our website, chat experience, and related features (together, "Go Girlfriend", "GG", "we", "us", or "our").

By creating an account, accessing, or using the Service, you agree to these Terms. If you don't agree, do not use the Service.

1. Who we are

2. Definitions

Account means your registered profile for the Service.

Content means text, images, audio, video, files, prompts, messages, or other material.

User Content means Content you submit, post, upload, or provide to the Service (including prompts and messages).

AI Output means responses, suggestions, or generated material produced by the Service.

Subscription means any paid plan, including trials or renewals.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm you meet this requirement and have the legal capacity to enter into these Terms.

4. Account registration and security

You are responsible for:

  • providing accurate information,
  • maintaining the confidentiality of your login credentials, and
  • all activity that occurs under your Account.

Tell us immediately if you suspect unauthorised use of your Account.

5. The Service is AI-based (important)

Go Girlfriend uses automated systems (including artificial intelligence) to generate responses. You acknowledge and agree that:

  • AI Output may be inaccurate, incomplete, misleading, or inappropriate.
  • The Service does not guarantee any particular outcomes, accuracy, emotional compatibility, or suitability for a specific purpose.
  • You are solely responsible for how you interpret, use, and act on AI Output.

6. Not professional advice

Go Girlfriend is for information, reflection, and companionship-style conversation only.

It is not a substitute for professional advice, diagnosis, or treatment, and should not be relied upon as medical, psychological, legal, financial, or other professional advice.

If you need professional help, contact a qualified professional. If you are in immediate danger, call emergency services.

7. Safety, self-harm, and crisis situations

The Service is not designed for emergency support. If you are experiencing a crisis or are at risk of harm to yourself or others:

  • Call 000 (Australia) immediately, or
  • contact Lifeline (13 11 14), Beyond Blue (1300 22 4636), or local emergency/crisis services.

We may restrict or suspend accounts that present serious safety risks or misuse the Service.

8. Acceptable use

You agree not to use the Service to:

  • break any law or infringe anyone's rights,
  • harass, threaten, abuse, exploit, or harm anyone,
  • generate or share illegal content,
  • attempt to reverse engineer, scrape, disrupt, or overload the Service,
  • bypass safety or access controls, or
  • misrepresent AI Output as professional advice or as coming from a real human.

We may remove Content or restrict access if we reasonably believe you've breached these Terms.

9. User Content and permissions

You retain ownership of your User Content (as between you and us).

By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, and use your User Content only as needed to:

  • operate and provide the Service,
  • maintain safety, security, and integrity,
  • comply with legal obligations, and
  • improve functionality (subject to our Privacy Policy and your settings where applicable).

You confirm you have the rights to submit your User Content and that it doesn't violate any laws or third-party rights.

10. AI Output and intellectual property

Unless otherwise stated, we (and/or our licensors) own all intellectual property rights in the Service, including software, branding, designs, and underlying systems.

AI Output: You may use AI Output for personal and lawful purposes. You acknowledge that:

  • AI Output may not be unique,
  • similar or identical outputs may be generated for other users, and
  • we do not guarantee that AI Output will be original or non-infringing.

11. Subscriptions, billing, cancellation (web only)

If you purchase a Subscription, you agree to the pricing and billing terms shown at checkout.

Payment processing: Payments are processed via our third-party payment provider(s) (e.g., Stripe). We do not store full card details.

Auto-renewal: Subscriptions renew automatically at the end of each billing period unless you cancel before renewal.

How to cancel: You can cancel at any time through your account settings / billing portal at: Account → Billing. Cancellation takes effect at the end of the current paid billing period unless stated otherwise.

Price changes: We may change pricing with reasonable notice. Changes apply from your next renewal unless otherwise stated.

Refunds: Refunds are provided as required under the Australian Consumer Law. Otherwise, fees are non-refundable, including for partial periods or unused time, unless we state otherwise in writing.

Chargebacks: If you initiate a chargeback without contacting us first, we may suspend your Account while the dispute is resolved.

12. Third-party services

The Service may rely on third-party services (e.g., hosting, analytics, AI providers, payment processors). Those services may have their own terms and policies. We are not responsible for third-party services we don't control.

13. Privacy

Your use of the Service is also governed by our Privacy Policy linked in the footer. The Privacy Policy explains what we collect, how we use it, and your rights and choices.

14. Service availability and changes

We may change, suspend, or discontinue any part of the Service at any time (including features, personas, or availability) for operational, legal, or safety reasons.

We don't guarantee uninterrupted availability. Planned or unplanned downtime may occur.

15. Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation.

16. Disclaimers

To the maximum extent permitted by law:

The Service is provided "as is" and "as available". We make no warranties that the Service will be error-free, secure, or meet your expectations. We do not warrant the accuracy, reliability, or suitability of AI Output.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded.

18. Limitation of liability

To the maximum extent permitted by law, and subject to section 17:

  • We are not liable for indirect, consequential, special, or exemplary damages, or loss of profits, revenue, goodwill, data, or opportunity.
  • Our total liability for any claim relating to the Service is limited to the amount you paid to us for the Service in the 3 months before the event giving rise to the claim (or, if you haven't paid anything, AUD $100), unless the law requires otherwise.

You acknowledge you use the Service at your own discretion and risk.

19. Indemnity

You agree to indemnify us (and our directors, employees, contractors, and partners) against any claims, losses, liabilities, and expenses arising from:

  • your use of the Service,
  • your User Content,
  • your breach of these Terms, or
  • your violation of any law or third-party rights.

20. Termination

You may stop using the Service at any time.

We may suspend or terminate your access immediately if we reasonably believe:

  • you've breached these Terms,
  • your use creates legal or safety risk, or
  • we must do so to comply with law.

On termination, your right to use the Service stops immediately.

21. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (e.g., via the Service or email). Your continued use after changes take effect means you accept the updated Terms.

22. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.

2. What personal information we collect

a) Information you provide directly

  • Account details: name (if provided), email address, login identifiers, and basic profile details.
  • User Content: messages you send in chat, prompts, uploads you provide (if enabled), and any information you choose to share.
  • Support communications: requests, feedback, and communications with us.

b) Payment and subscription information (web-only)

Payments are processed by our third-party payment provider(s) (e.g., Stripe). We typically receive:

  • subscription status (active/cancelled),
  • plan type, billing dates, and transaction identifiers, and
  • limited billing metadata (e.g., country, last 4 digits, payment method type).

We do not store full card numbers. Card handling is done by the payment processor.

c) Technical and usage information

We may collect:

  • device and browser information,
  • IP address (which may be personal information),
  • timestamps, pages viewed, clicks and session activity,
  • approximate location (derived from IP), and
  • diagnostic logs (error reports, performance data).

d) Cookies and similar technologies

We use cookies (and similar tools) to:

  • keep you logged in,
  • remember preferences,
  • measure performance and usage, and
  • improve the Service.

You can control cookies via your browser settings. Some cookies are required for the Service to function.

3. Why we collect and use your information

We use personal information to:

  • Provide the Service (account creation, login, delivering chat and features).
  • Operate subscriptions (billing status, access control, fraud prevention).
  • Improve and maintain the Service (debugging, analytics, performance, feature development).
  • Safety and security (detect misuse, prevent fraud, protect users and the platform).
  • Support (respond to requests and troubleshoot issues).
  • Legal compliance (meet obligations and respond to lawful requests).
  • Communications (service updates, billing notices, important changes).

We do not sell your personal information.

4. AI processing and your chat content (important)

Go Girlfriend is an AI-based service. That means your User Content (including chat messages) may be processed to generate responses and operate the Service.

Depending on how the Service is configured, your User Content may be:

  • transmitted to and processed by third-party service providers that help us deliver AI functionality (e.g., model/API providers), and
  • stored to provide conversation continuity, account features, moderation, safety, and support.

Please avoid entering information you do not want processed or stored, including highly sensitive personal details, unless you are comfortable doing so.

5. When we share personal information

We may share personal information with:

a) Service providers (processors)

We use trusted third parties to help operate the Service, such as:

  • hosting and infrastructure providers,
  • analytics providers,
  • customer support tools,
  • authentication / membership providers (e.g., Memberstack), and
  • payment processors (e.g., Stripe),
  • AI providers (model/API providers).

They are only permitted to handle your information for the purposes we specify, and we take reasonable steps to ensure appropriate safeguards are in place.

b) Legal and safety reasons

We may disclose information where we reasonably believe it is necessary to:

  • comply with law, regulation, subpoena, court order, or lawful request,
  • protect the rights, property, or safety of users, the public, or our business,
  • investigate fraud, security, or technical issues.

c) Business changes

If we're involved in a merger, acquisition, sale of assets, or corporate restructure, your information may be transferred as part of that transaction (subject to this Policy).

6. International data transfers

Some of our service providers may store or process information outside Australia (for example in the United States or other regions). Where we transfer information internationally, we take reasonable steps to ensure it is protected through contractual and other safeguards consistent with applicable privacy laws.

7. Data retention

We keep personal information only as long as reasonably necessary to:

  • provide the Service,
  • meet legal and accounting obligations,
  • resolve disputes, and
  • enforce our agreements.

Chat data retention: We may retain chat history associated with your Account for as long as your account is active, unless longer retention is required for legal or safety reasons. You can request deletion at any time through your account settings or by contacting us.

8. Your rights and choices

Depending on your location and applicable laws, you may have rights to:

  • Access the personal information we hold about you,
  • Correct inaccurate information,
  • Delete certain information (including account deletion),
  • Withdraw consent where processing is based on consent, and
  • Opt out of marketing communications (if we send them).

To make a request, contact us at labs@firstkind.ai. We may need to verify your identity.

Account deletion: You can request deletion by Account → Settings → Delete account or emailing labs@firstkind.ai. Some information may be retained as required by law or for legitimate business purposes (e.g., fraud prevention).

9. Security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. No online service is 100% secure, so you use the Service at your own risk.

10. Children

The Service is not intended for children. You must be 18+ to use Go Girlfriend. If you believe a child has provided us personal information, contact us and we'll take steps to delete it.

11. Marketing and communications

We may send essential service communications (e.g., billing notices, security alerts, product changes). If we send marketing communications, you can unsubscribe at any time using the link in the message or by contacting us.

12. Links to other sites

Our Service may contain links to third-party sites or services. We're not responsible for their privacy practices.

13. Changes to this Policy

We may update this Privacy Policy from time to time. If changes are material, we will take reasonable steps to notify you (for example via the Service or email). The updated version will apply from the "Last updated" date.
